Facts:
After a bench trial in the Circuit Court of Loudoun
(Virginia), the trial court granted plaintiff wife a divorce from defendant
husband on the grounds of cruelty. The divorce decree also imposed a monthly
alimony and child support obligation upon the husband. Challenging the
sufficiency of the evidence to support the decree and the alimony and child
support award, the husband appealed.

- With respect to a claim
for divorce on the grounds of cruelty, the court notes that cruelty is
cumulative, and while acts of violence committed at an earlier period, and
which have not prevented a wife from living with her husband, or going
back to him after they have been separated, cannot be made the sole
foundation of an action for separation, they form the subject of
investigation and proof with a view to determine what is the true issue in
the case, namely: whether the wife can with safety to her person and health
continue to live with him.
